Get Driving online therapy toolkit / Online courses:
Terms of Use
- Where the Participant is less than 16 years of age, references in these Waiver Terms to “I” / “my”/ “myself”, are to the Guardian on its own behalf an/or on behalf of the Participant, as the context requires.
- In consideration of purchase of the Get Driving online therapy toolkit or Senior Driver's online course, I, to the greatest extent permissible by law, hereby release, waive and hold harmless the Business owner from any and all Claims I may have against the Business owner arising from any Harm I suffer, whether directly or indirectly, from or in connection with my participation in educational materials and therapy resources from the toolkit and/or online courses.
- I acknowledge that I am voluntarily purchasing the toolkit/ online course and understand that these materials refer to driving skills, and that I may be in a moving vehicle when practicing any of the skills mentioned in the courses, and that there are certain inherent risks of being in a moving vehicle in an on-road environment.
- I warrant that:
- If I am a Guardian, I have authority to act as the Guardian of the Participant and to bind myself, the Participant and each other person responsible for the Participant to this Waiver;
- I am physically and mentally sound to proceed with purchase of the toolkit / online courses and use of materials (where relevant, with a suitably qualified driver).
- I fully understand that participating in the activities within the Passenger Activities involves being in a moving vehicle in an on-road environment, where risk of collision is inherent for any driver; and accordingly represent that I:
- Will not attend Passenger Activities while under the influence of any drugs, alcohol or medications, that may impair my behaviour or judgement; and
- Will not behave in a disruptive or dangerous manner.
5. I understand and agree that my purchase of the toolkit / online course/s is proof of my intention to provide a complete, unconditional waiver and release of all liability in respect of the Business Owner, to the fullest extent of the law.
Tips for Passenger activities
- Passenger activities means that an experienced driver is driving the car at all times and they are providing opportunities for the learner/pre-learner driver (sitting in the front passenger seat) to practice visual processing, planning and decision skills, in order to prepare for specialised driving lessons.
- It is recommended that the driver ensure that they have comprehensive car insurance
- Passenger activities conducted by OT driver assessors are therapeutic interventions designed to allow practice and upgrading of visual processing and planning skills, in order to prepare for driving lesson.
- The driver should ensure at all times that they are in control of the vehicle and do not feel distracted. When an explanation or discussion needs to occur, it is recommended that the driver find a safe place to pull over; if driving demands suddenly change, it is recommended that the driver do whatever they need to in order to focus their attention to the driving task.
- The driver should always make their own decisions; eg if the learner/pre-learner driver misjudges a gap or missies a sign, the driver will naturally observe this and
- Drivers should only offer these practice opportunities if they feel they are competent to do so.
Tips for Driving OTs and Generalist OTs:
- This therapy toolkit does not replace an OT driving assessment or potential to drive assessment.
- OT driver assessors are NOT driving instructors, and do not purport to be providing training, demonstration, advice or instruction regarding learning to drive.
- The therapy toolkit is for use ideally AFTER a potential to drive assessment, to develop underlying skills needed for driving (motor coordination, visual search, processing and planning).
- Driving therapy sessions do not count towards driving lessons hours and do not replace the need for specialised driving lessons.
- OT driver assessors are recommended to seek their own legal and/or insurance broker advice.
Driving Well Occupational Therapy accepts no liability regarding other persons' decisions to provide practice opportunities for learner/pre-learner/returning drivers through passenger activities.
Definitions:
Passenger Activities means the therapy activities conducted with the therapist and Participant, with the therapist driving their own, comprehensively insured car (including CTP), and engaging the Participant in practicing individual components of driving, including but not limited to: lane position awareness, visual search, gap selection, problem solving, hazard management, and driving procedures.
Business owner means Driving Well Occupational Therapy and its individual members, managers, directors, officers, agents, employees, volunteers, representatives, servants, predecessors, successors, assigns, affiliated entities, heirs, personal representatives and all other persons, firms or entities claiming by or through them.
Claim includes but is not limited to, a demand, claim, action, dispute or proceeding for loss and damages (including negligence) made or brought by or against the person, however arising and whether present, uncertainty, immediate, future or contingent.
Harm includes but is not limited to, any and all physical injury; death; stress; psychological trauma; emotional trauma; illness; ailment; and any damage to or loss of property.
